Mediation & Arbitration
As a trial lawyer who has always worked on various cases from both sides of the ‘v’ Mr. Murphy is also active in the area of Alternative Dispute Resolution (ADR). Mindful that it is important to try cases in order to know when to settle and just as important to be able to settle them so as to know which ones should go to trial, Mr. Murphy has been active in the field of ADR both as a Mediator and as an Arbitrator.
Certified as a Mediator in 1993, Mr. Murphy has years of experience in helping parties settle or arbitrate a wide range of personal injury cases (from simple motor vehicle to complex product liability matters), as well as commercial cases, employment issues, and disability claims of various kinds. With an active case load unlike full-time Mediators, he brings to the process not only his experience at the trial bar but his current understanding of the realities of today’s verdicts from judges and juries.
The payment system varies. In two-party cases, the fees and expenses are borne equally by both sides. In multi-party cases there is either a fixed amount per party or, depending on the case, can be billed hourly with the fees and costs distributed evenly among the parties.
