Conte v. Dayton Power & Light Co. – $3.5M Verdict plus $1M interest
Mr. Conte was painting a 120-foot watertower with high voltage power lines close by at a manufacturing plant in Sidney, Ohio.  Painting from top to bottom as he repelled down in a boatswains chair, when he got to the level of the power lines his extension pole hit one of the lines and he received a massive electrical shock.  The case went to trial against the plant’s owner and the local power company, and after three week at trial the jury awarded Mr. Conte $3.5 million. The power company refused to pay and took the case to the Court of Appeals where Mr. Murphy was again successful; the Court upheld the $3.5 million verdict and also awarded Conte almost $1 million in interest.  The Court’s decision is recorded at 215 F.3d 628 (2000).

Trucker v. Penske Truck Leasing Co., L.P. – $450,000 Settlement

A truck driver was making a delivery in Rhode Island when he injured his shoulder – which his doctor later discovered to be a torn rotator cuff – while opening a lift gate on a Penske truck.  The lift gate had not been properly maintained but Penske fought the case by trying to blame the company that made the lift gate, Waltco Truck Equipment.  After collecting the evidence the Firm then brought a consumer protection claim against Penske who then agreed to attend Mediation.  After viewing the attached presentation. Penske agreed to pay $450,000 to settle the case and abandoned its claim that Waltco was responsible.

Worker v. Lundy’s Fence Company – $180,000 Settlement

Late one October night a Dunkin’ Donuts worker in Lynn, Massachusetts, had to close a sliding gate in a chain-link fence surrounding the store.  As she did so her hand got crushed in the unguarded pinch-point of the fence roller.   Fortunately her medical bills and lost wages were covered by workers’ compensation but pain and suffering were not, and never are.  The Firm was able to prove the company that installed the fence was liable for the worker’s injury.  Showing that the industry standard at the time required rollers to be guarded, and that guards were available when the defendant installed the fence, the Firm proved the poor installation was a cause of the injury.  Shortly before trial in Essex County the defendant’s insurer agreed to attend a day-long Mediation and settled for $180,000 which was more than the insurance company had set for its reserve.
